A:
- If the board decides to impose discipline on a member (e.g., fines, suspension, damage reimbursement charges) Civil Code section 5855(c) requires the association to “provide the member written notification of the decision, by either personal delivery or individual delivery pursuant to section 4040, within 15 days following the action.”
- If the post-hearing notice of decision is not timely sent, the discipline or charges “shall not be effective,” and the association cannot impose or enforce the discipline. (Civ. Code §5855(d).)
- To correct this error, you must notice another hearing, you may confirm the decisions, and then you must timely send the post-hearing notice of decision.
