Q. Trusts are becoming more common. Can you speak to:
  • Who can serve on the board?
  • Who can be served and fined?
  • Who can authorize access to a residence?
A.  The trustee(s) of the trust listed on title should be treated as the owners who are members. Those trustees on title can serve on the board, can be sent violation notices/fined, and can authorize access to a residence. Beneficiaries of a trust are not owners or members.   —Jillian M.
