Wood-Destroying Pests

Unless the governing document provide otherwise, the Association is responsible for the treatment and eradication of wood destroying pests, including termites, wood boring insects, fungus, and other wood destroying organisms in the common areas, while this owner is responsible for these items found in the owner’s separate interest. (Civ. Code §4775(b) and 4780) When the Association is responsible, the Association may elect the eradication method to be used. Lamden v La Jolla Shores Clubdominiums (1999) 21 Cal. 4th 289, 87 Cal.
